Terms and Conditions of Business

Tenancy Agreement

We will prepare a comprehensive Tenancy Agreement in accordance with English Law to protect the Landlord’s interests. Our standard Tenancy Agreement is an Assured Shorthold Tenancy, which is for a minimum term of 6 months renewable thereafter by mutual agreement. The cost of drafting this agreement is included in our letting fee. A section 21 notice requiring possession will be issued to the Tenant at the start of each new tenancy. If the tenant does not meet the requirements of an Assured Shorthold Tenancy we shall draft a Non-Housing Act Tenancy.

References

We will obtain references on prospective Tenants as appropriate including employers, previous landlord, banking and credit check as necessary. Where we can not obtain suitable references we shall approach you, as the Landlord, for your agreement to take six months rent in advance and a raised security deposit of two months rent.

Inventory

Immediately prior to the letting of the property we will prepare an inventory and schedule of conditions. At the end of the term of the tenancy we will check the inventory and schedule of conditions and deduct from the deposit paid by the Tenant, any amount for damage to the Landlord’s property or possessions. We can accept no responsibility for damage to the Landlord’s property or possessions caused by the Tenant above the amount deducted from the Tenant’s deposit for any such damage

Property Repairs

We will investigate any repairs necessary reported at the property and instruct contractors to carry out any necessary work. Repairs up to £150 will be carried out without prior reference to the Landlord and above that amount shall be subject to the Landlord’s prior approval. The Landlord is free to instruct his own contractors to carry out any work should he wish to do so. We reserve the right to instruct contractors to carry out emergency work or work necessary where we have been unable to contact the Landlord for prior approval.

Net Rental Transfer

We will automatically transfer the net rental receipts to your account when we are in receipt of cleared funds from the Tenant, Landlords are paid within 14 days by BACS transfer. We will deduct from these receipts any amounts outstanding from the Landlord for necessary repairs or maintenance carried out at the property.

Tenant’s Breaches

In the event that it becomes necessary to take legal action against a Tenant you will be responsible for instructing a solicitor and all subsequent fees.

Client Identification

Under the provision of the Proceeds of Crime Act 2002, it is a legal requirement that the agent must be able to identify their client. All Private Landlords must provide Dandara Lettings with a copy of their passport or EU Photo Driving Licence and proof of address to be held on file in accordance with Data Protection Act 1988.

Where there are joint Landlords (except for Husband and Wife) a copy of the relevant identification for each Landlord will be required.

Where the Landlord is a Company, at least two directors must provide us with the relevant information.

Termination of Agreement

The agency agreement may be terminated at no charge when dandara Lettings have not identified a suitable Tenant. However, where dandara Lettings has introduced a suitable Tenant and the Landlord refuses to allow the tenancy to proceed, the Landlord will be liable to pay a withdrawal fee of £200 + VAT.
